SB 4-D in Palm Beach County:

In Palm Beach County, this affects virtually every legacy condo community. This guide explains what it means for buyers.

Which PBC Communities Are Affected

Every condo community built before 1996 with buildings three stories or taller. This includes: Century Village Boca (7,500 units, 1970–1995), Century Village WPB (6,500 units, 1970–1995), Kings Point (7,200 units, 1973–1985), Villages of Oriole (older sections), Sterling Village (840 units, 1966–1967), Village Royale (880 units, 1969–1983), High Point of Boynton Beach (500 units, 1966–1971), Colonial Club (504 units, 1973–1983), Banyan Springs (658 units, 1977–1995), and dozens of smaller communities.

What Is Required

Milestone inspection: A structural inspection of the building by a licensed engineer at 30 years of age, then every 10 years. Buildings within 3 miles of the coast must complete the first inspection at 25 years. Structural integrity reserve study: A study identifying the remaining useful life of structural components and the funding needed to replace them. Fully funded reserves: Associations can no longer waive or underfund reserves for structural components (roof, load-bearing walls, foundation, electrical, plumbing, windows, fire protection). This is the change that is driving special assessments — associations that operated for decades with minimal reserves now must fund them to 100%.

What It Means for Buyers

Before buying any condo in a building 30+ years old, you must request: the milestone inspection report, the structural integrity reserve study, the current reserve fund balance and percentage funded, any pending or recently passed special assessments, and the building's insurance policy and premium history. A building with a clean milestone inspection and a 70%+ funded reserve is in a manageable position. A building with significant findings and a 20% funded reserve is facing a large special assessment. Both exist in PBC — sometimes in the same community.

Communities NOT affected by SB 4-D

Single-family communities (Cascade Lakes, Boynton Leisureville, Valencia series, Cresswind, Regency at Avenir) are not affected. Attached villa communities that are 1–2 stories (Whisper Walk, Floral Lakes, Bent Tree Villas) may not be affected depending on building height. SB 4-D targets buildings 3+ stories tall. If you want to avoid SB 4-D entirely, choose a single-family or low-rise villa community.
