Arizona 55+ Age Rules — What HOPA Actually Says
The federal Housing for Older Persons Act (HOPA) governs who can live in 55+ communities. The rules are more nuanced than most buyers assume — understanding them before you buy prevents surprises about family members, guests, and future life changes.

At least 80% of the occupied units in a HOPA-qualifying community must have at least one resident who is 55 or older. The remaining 20% of units can be occupied by people under 55 without the community losing its 55+ designation. This is why you occasionally encounter younger residents in even the most established 55+ communities.
Only one resident per household needs to be 55 or older. A 57-year-old and a 48-year-old spouse or partner can both legally reside in a HOPA community. The age requirement applies to at least one resident per occupied unit, not all residents.
Minor children (under 18) cannot be permanent residents of a HOPA-qualifying 55+ community. Grandchildren and great-grandchildren cannot live with you permanently. This is the rule that most surprises buyers who have grandchildren they expected to take in. Extended visits are typically permitted with time limits — verify the specific community policy.
HOPA requires communities to actively verify and document that they meet the 80% threshold. Most communities maintain age verification records on file. When you buy, you will be required to provide documentation of age (typically a copy of a driver's license or passport for the qualifying resident).
If a resident of a 55+ community dies and leaves a surviving spouse who is under 55, the surviving spouse can typically continue to reside in the community. This protects couples from being forced to move due to the death of the qualifying spouse. Verify the specific community policy.

Common Buyer Questions
| Can my adult child move in with me? | Generally yes if they are 18+ — but most communities have HOA rules about maximum occupancy and the number of non-age-qualifying residents. Verify with the specific community HOA. |
| Can grandchildren visit? | Yes — visiting grandchildren are not permanent residents. Most communities have a guest stay policy (typically 30–60 days per year). Verify the specific community's guest policy. |
| Can a 50-year-old spouse live with me? | Yes — one resident of the household must be 55+. The other can be younger. A 56-year-old and a 50-year-old spouse can both legally reside. |
| What if I need to move a parent in for care? | A parent over 55 could be the qualifying resident if they are the primary resident. If you are under 55 yourself, verify the specific HOA rules — some communities require the qualifying resident to be the deed holder. |
| Can I rent my home to a couple under 55? | No — rental must still meet HOPA requirements. Tenants must include at least one person 55+. Renting to an all-under-55 household violates HOPA. |
| What happens if the community drops below 80%? | The community loses its HOPA exemption and becomes an all-ages community. This rarely happens in established communities but has occurred when demographics shift in older manufactured home parks. |
