55+ Community Age Restriction Rules —
What You Need to Know

Can a 48-year-old spouse move in? Can your adult child live with you? Can you rent? The federal HOPA rules govern all of this — and most buyers do not fully understand them before they buy, in any state.

The Housing for Older Persons Act (HOPA)

The federal Housing for Older Persons Act (HOPA) governs 55+ communities across the United States. Under HOPA, a community qualifies as 55+ housing — and is therefore exempt from the Fair Housing Act's prohibition on familial status discrimination — if it meets three requirements:

  • At least 80% of occupied units must have at least one resident who is 55 or older.
  • The community must publish and follow policies demonstrating intent to be 55+ housing.
  • The community must conduct age verification of residents.

The 80% rule is important: it means up to 20% of units can be occupied by residents under 55. That figure is a ceiling on how much flexibility a community is legally permitted to have — it is not an entitlement that lets any specific household move a relative in. Whether a given community actually uses that flexibility, and how, is decided by that community's own governing documents, not by HOPA itself. Most well-managed, established 55+ communities maintain well above 80% compliance.

The Questions Buyers Actually Ask

One spouse is 55, one is 52 — can we buy?Yes. HOPA requires at least one resident per unit to be 55 or older. The younger spouse can live there.
Can our adult child (age 30) live with us?Depends entirely on the community's specific rules — some allow it outright, some require a documented live-in-caregiver approval process, and some communities have fought this in court even after the parent has died and the child inherited the home. See our full guide on adult-child caregiver rules before assuming anything.
Can minor grandchildren visit?Yes — guests are permitted. HOPA restrictions apply to permanent residents, not guests. Length of stay rules vary by community.
Can we rent the home?Depends on HOA rules. Many 55+ communities have rental restrictions. Review the HOA rules before buying if rental is a possibility in your future.
What if I turn 55 after I buy?Not applicable — you must be 55 at time of purchase for the age-qualified resident requirement to be met.
What happens if a resident dies and the surviving spouse is under 55?Most HOPA communities have provisions allowing the surviving spouse to remain. Confirm specifics with the HOA.
Always Confirm with the Specific CommunityHOPA sets the federal floor — individual communities can be more restrictive in their rules. Always review the specific HOA declaration and rules for any community you are considering, particularly around rental restrictions, guest policies, and occupancy rules.
